This privacy policy tells you about the ways we ensure the privacy and the confidentiality of your "Personal Information" (i.e. information about an identified individual as defined in the Personal Information Protection and Electronic Documents Act).

When you provide us with Personal Information you AGREE AND CONSENT that we may collect, use and disclose your Personal Information in accordance with this privacy policy as may be revised from time to time or as may be required by law. If you do not agree with these terms, you should NOT provide any Personal Information to us.

Any revisions to this policy will be effective as of the revision's publication date. An up-to-date version shall be posted on our webpage, www.mbb.ca, and can also be obtained from any of our lawyers or staff upon your request.

  1. Collecting and using Personal Information

    We collect Personal Information from you so that we may provide legal or other services for which you have retained us. If there is any further or other purposes, we shall explain to you all purposes for such collection either before or at the time of collection. We shall limit the Personal Information we collect to what we need for the said purposes, and we shall use it only for such purposes. We are required by law to first obtain your consent if we wish to use your Personal Information for any other purpose(s) which have not previously been consented to by you.


  2. Disclosing Personal Information

    In the course of our service to you we may be required to provide your Personal Information to other persons. We shall do so where:

    • we have your consent;

    • the other parties are our agents who assist us in serving you;
    • such disclosure is reasonably necessary for conducting the transaction or matter or services you have retained us to handle or provide; or
    • we are required or permitted to do so by law.

    We are not in the business of selling customer lists or information to others and assure you that we shall not do so with your Personal Information.

    Upon signing a retainer with us you consent to us releasing Personal Information:
    • for conducting the transaction you are engaging in;
    • as is required by law; and
    • to our agents for conducting the transaction you are engaging in (for example, search agents who conduct searches which are necessary for certain transactions).

  3. Protecting Personal Information

    We shall protect your Personal Information with safeguards and security measures appropriate to the sensitivity of the information.


  4. Providing you access to your Personal Information and maintaining its accuracy

    Upon your request, we shall give you access to the Personal Information we retain about you.

    We shall make reasonable efforts to keep your Personal Information accurate for the purpose collected.

    Please note that we may not be able to provide information about you from our records which contains references to other persons which is subject to legal privilege, relates to an investigation of breach of agreement or contravention of laws, or cannot be disclosed for other legal reasons.


  5. Respecting and responding to your privacy concerns

    In this privacy policy, we have explained our practice of collecting, using and disclosing your Personal Information and your options for refusing or withdrawing your consent for us to do so. We shall investigate and respond to any of your concerns about any aspect of our handling of your Personal Information and shall record and respect your choices.
